The Instructors of Elizabeth- Specialized Driving instructors are independent licensee of not an agent, Contractor or an employee. Collectively the Instructor and the Facilitator are referred to as the Driving School.

We provide lessons on the Terms which take effect at the time of booking. If you book more than one lesson at the same time the Terms at the time of the booking will apply to each lesson booked. In return for the payment of the Lesson Cost we provide you with a Lesson by the instructor at the time of booking unless otherwise notified by us.

The terms may be varied at any time subject to giving you reasonable notice via the website. If you continue to book lessons after the date on which any changes to the terms take effect, you will be deemed to have agreed to such changes.

License

The Learner/driver must before, during and after the Lesson:

Arrive at the agreed place for the lesson to commence in sufficient time for the lesson to begin on time or make reasonable efforts to inform the instructor otherwise
Be capable of controlling the vehicle in a safe manner
Hold a current state or territory learners driving permit or equivalent overseas licence and carry it with them at all times
Not wear high heels, thongs or other footwear which may cause safety concerns with the foot controls
Comply with the instructions or directions of the instructor
Comply with all road rules and all special requirements of the learners permit to drive
Behave appropriately and not harass, abuse or threaten the instructor or other person’
If another person is to be in the vehicle consent must be obtained prior to the lesson
Be in a fit physical and mental state to drive a vehicle and in particular not be under the influence of alcohol or drugs wheather prescription, legal or illegal. Tired or be otherwise unable to concentrate or control the vehicle
Keep mobile phones on silent and do not attempt to use a mobile phone while in operation of the vehicle
Be courteous of other road uses
The learner or driver holds all financial responsibility in case of an accident or fine

Packages We provide lesson Packages, on the terms which take effect at the time of purchase. The lessons in the packages are redeemable for the specified lesson types unless otherwise agreed to by the facilitator. The packages are not refundable, redeemable for cash or transferable. The packages have an expiry, usually for no more than 6 months from the date of purchase. Upon expiry all unused lessons are forfeited. When redeeming the packages and making a booking all terms and conditions relating to bookings, including but not limited to cancellations, lateness and non-attendance terms apply to individual bookings. The packages upon application can be cancelled but it is at our absolute discretion. The amount refunded will be calculated as the difference between full retail value of the lesson package at the time of purchase and the total of the cost of driving lessons, taken or cancelled and the fees for the cost of the transaction. Booking a Lesson with us You must book all Lessons through the instructor, office or website. If you book a lesson through the instructor you agree that the terms apply to that lessons as if it was booked through the office or website. The duration of the lesson includes both on-road and off-road time, briefing and de-briefing time. Lessons commence at a pick-up point and time determined at the time of booking unless otherwise agreed with the instructor. Current charges and lessons available are published on the website. Booking your driving test with us You may book your Driving Test directly with the Regulator in your State or Territory or where available, or arrange for us to book the Driving Test on your half. You may book a test day package service in respect of a driving test you have booked with a regulator in your state or territory, but, If you book through your Regulatory state or territory we cannot guarantee your instructor will be available. When booking a test day package or service through the instructor you agree that the terms apply to that lessons as if it was booked through the office or website. The duration of the lesson includes both on-road and off-road time, briefing and de-briefing time. Lessons commence at a pick-up point and time determined at the time of booking unless otherwise agreed with the instructor. Current charges and lessons available are published on the website. Payment You must pay the lesson cost in full at the time of booking or advise that you will be paying the instructor before commencement of the lesson. The instructor is not obliged to provide you with a lesson if the lesson cost has not been paid in full. If the instructor provides you with the lesson before the lesson cost it paid in full or any part of the lesson cost is outstanding for the lesson including cancelling, rescheduling, lateness and no shows, than the lesson is a debt due to us and payable immediately on demand whether or not any further lessons are provided. Package cost are paid in full prior to the time of booking. The instructor is not obliged to provide you with a lesson from the package if the package has not been paid on full. If the instructor provides you with a lesson before the package is paid in full or any park of the lesson cost is outstanding for the lesson including cancelling, rescheduling, lateness and no shows, than the lesson is a debt due to us and payable immediately on demand whether or not any further lessons are provided. A Tax invoice for each lesson is available on request. Cancellation and No Show Policy- We bring to your attention that we have a cancellation and no show policy which includes a cancellation fee. As our instructors are often very busy, we ask that you contact your instructor at least 36 hours prior to your scheduled lesson if you need to cancel or postpone for any reason. If not, a cancellation fee of half or all the lesson cost may apply. This allows our instructors to better serve all their students, by giving them the ability to offer any spare times to those students who may be desperate for additional driving time with their instructor. The cancellation policy is as follows: Rescheduling or Cancelling a driving lessons and or test day service packages- If you reschedule a Lesson within less than 36 hours advance notice of the scheduled time, we reserve the right to consider the Lesson cancelled and charge as set out below Period of notice prior to the scheduled Lesson- 12 hour or less- No credit More than 12 hours’ notice but less than 36 hours- 50% of the lesson cost Lateness and non-attendance (no shows)- If you arrive late for a Lesson the Instructor shall only be able to offer you the remaining Lesson time if they do not have another commitment to another Lesson immediately after, and you will be charged for the full Cost of the Lesson. If you are more than 15 min late for a Lesson without notifying us we reserve the right (at the Instructor’s reasonable discretion) to cancel the Lesson and charge the full lesson cost. If you do not attend a lesson (No show) we reserve the right to cancel the Lesson (at the Instructor’s reasonable discretion) and charge the full lesson cost. Packages- We provide Lesson Packages, on the Terms which take effect at the time of purchase. The packages are non-refundable or redeemable for cash or transferable. The packages have an expiry date 6 months after the date of purchase. It is not our job to keep you up to date with the use of the packages or reminders of when your packages are going to expire. Upon expiry all unused lessons are forfeited. When a lesson of the package is redeemed and booked, all terms and conditions in relation to bookings, including cancellations, rescheduling, lateness and non-attendance apply to the booking. Liability relating to use of our vehicle If you use our vehicles for a practical driving test with a Queensland government license examiner or any other equivalent state or territory based test and the instructor is not present in the vehicle during the practical driving test or if the instructor is present and you fail to follow the directions given by the instructor during the lesson, you will be responsible for the lower of the cost of repairs relating to damage caused or the insurance excess applicable should our vehicle be damaged for whatever reason. You will always be responsible for traffic infringement notices arising while driving our vehicles. Your vehicle used in lessons A lesson may be provided by the instructor in your vehicle if so requested at the time of the bookings. It is your responsibility for your vehicle to be registered, insured, and safe, fit for the purpose of providing the lesson and displays all signs required by law in relation to learner driving. If your vehicle does not meet any of the requirements at the commencement of the lesson the lesson will be conducted in the instructor’s car. If you do not wish to have the lesson in the instructor’s car then the lesson will be cancelled and the lesson cost will not be refunded/ the lesson cost is outstanding and payable immediately weather or not another lesson is made. You and you alone will be responsible for the cost of repairs in relating to damage caused or the insurance excess applicable should your vehicle be damaged for whatever reason Acknowledgements

The Instructor has sole discretion as to whether a lesson will commence or continue.
Participation in only one or a few driving lessons does not guarantee that you will acquire the necessary skills to pass a driving test
Driving a motor vehicle is an inherently risky activity and there is the risk of significant personal injury or damage to property
We do not accept any liability whatsoever for personal property that is left in the vehicle
If you are booking for a learner it is your responsibility to make sure the learner is aware of these terms and conditions.

No Warranty

If you are deemed competent by your instructor, your instructor may recommend you to sit a Queensland transport driving test however no warranty or guarantee that you will pass a practical driving test with a qld transport driving examiner or pass any other state or territory based test and or gain or develop the required skills to pass the driving test.
